The parents of a baby born on Thursday in a clinic in the city of Mendoza asked to postpone the vaccination and the court ordered that the inoculation be carried out and if necessary with the help of the public force, judicial sources reported.   Following this court decision, the parents declined their initial position and on Friday agreed to the vaccination schedule for their son.   The event occurred on Thursday at the Cuyo Clinic, located in the provincial capital, when the parents of the newborn refused to inoculate him, so Judge Rebeca Natalia Ropero had to intervene, who ordered that he should be vaccinated and if necessary with the use of public force.   Along with the Family Court, the Interdisciplinary Technical Team (ETI) also intervened to contain the family from the Mendoza town of Las Heras.   The justice system intervened to guarantee the inoculation of the newborn and that his right to health is not violated since they explained that the omission of the same has consequences in the Contravention Code, in its article 119, of Law 9099, the sources indicated.   In the article mentioned in one of its points it states: "Parents, guardians, curators or custodians who omit their obligation for their children or minors in their care to receive the mandatory vaccination included in the national calendar (Law No. 22,909), "They will be punished with a fine from two hundred (200) U.F. to eight hundred (800) U.F. or arrest of five (5) days or its equivalent in community work in care centers or public hospitals for minors."   In addition, it adds that "health providers (public or private) and any public agent or official who is aware of the violation of the right to vaccination of minors must communicate this circumstance to the local administrative authority; anyone who omits said communication will be sanctioned with double that provided for in the previous paragraph".
